What is mediation?

Mediation is a form of conflict resolution in which two or more parties who have a difference of opinion or conflict work together to find a solution. This process is supervised by a neutral and impartial mediator. Instead of a legal battle or going to court, mediation offers a constructive way to reach agreements that are acceptable to all parties involved.

How does mediation work?

In mediation, the parties, with the support of the mediator, look for a solution themselves. The mediator helps to guide the conversation, ensures clear communication and ensures that all parties can express their interests and wishes. Because the mediator does not make decisions, the parties themselves are in control. This often makes the solution more sustainable and better suited to the situation than a legal ruling.

When is mediation a good choice?

Mediation can be used for various types of conflicts, such as:

  • Labor disputes , for example between employer and employee.
  • Business disputes , such as conflicts between companies or partners.
  • Family and divorce matters , where clear agreements are required.
  • Neighbour disputes or conflicts within an association .
  • Disputes within the government or between citizens and authorities .

Even if there is already a lawsuit, mediation can help to reach a faster and more satisfactory solution. The judge is never present during a mediation process and the discussions are confidential.

What happens to the agreements?

When the parties reach a solution, the agreements can be recorded in a settlement agreement . This document is legally binding and can serve as an alternative to a court ruling.

Quality of mediation

Not every mediator is qualified. There are various quality registers in which recognized mediators are included. They meet strict codes of conduct and training requirements.

Ref Lips is affiliated with the ADR International Register , which means that it is recognized as a mediator and adheres to the highest quality standards.
